CoParent — Terms of Service
1. Acceptance
CoParent ("the app", "we", "us") is provided by CoParent Pty Ltd (ACN INSERT ACN]), an Australian company. By creating an account or using CoParent on iPhone, Android or the web (coparent.au), you agree to these Terms and to the [Privacy Policy. If you do not agree, do not use the app.
2. What CoParent is
CoParent is a tool to help separated parents organise shared parenting — calendars, expenses, messaging, documents, and related records. CoParent is not a law firm and does not provide legal, financial, medical, or mediation advice. Nothing in the app is a substitute for professional advice or a court order.
CoParent is not an emergency or crisis service. If you or a child are in danger, call 000 (or 111 in New Zealand).
3. Eligibility and accounts
- You must be 18 or older and capable of entering a binding agreement. A child's account can only be set up by their parents, who accept these Terms on the child's behalf.
- You must use your legal first and last name. This applies to everyone with an account, including support people and professionals. CoParent does not verify names, but records kept in the app may be relied on in court. Using a false name is a breach of these Terms and may lead to suspension, and using a false identity to deceive or harass someone may be a criminal offence.
- You are responsible for the accuracy of the information you enter, for keeping your login secure, and for activity under your account.
- You may invite other adults (co-parents, family, professionals) and control what they can see and do via the app's permission settings.
- When you create an account we use automated checks (including Cloudflare Turnstile) to stop fake or automated sign-ups. We may refuse or suspend an account that fails them.
4. Acceptable use
You agree not to:
- enter information you have no right to share, or use the app to harass, threaten, or abuse another person;
- upload unlawful content or attempt to access another user's data without authorisation;
- interfere with the security or operation of the app.
5. Records, deletion and retention
The app keeps an audit trail and retains records — including after a record or account is "deleted" — for legal/court reasons, as described in the Privacy Policy. Deleting something may hide it from you while retaining it for the other parent and the record.
6. AI features
Optional AI features send the content you submit to third-party providers in the United States: Anthropic for message tone check, receipt scanning, reading old records you import, the in-app Helper, checking a new medicine against your child's list, reading a court order or parenting plan to suggest a care schedule, and reading a school letter to suggest school holidays; and Deepgram for voice typing. The Privacy Policy explains what is sent. These features are off until you agree to them.
AI results are generated automatically and may be wrong or incomplete. Check them before you rely on them. In particular, a care schedule suggested from a court order or parenting plan is not legal advice or an interpretation of the order: the order itself is what applies. A medicine check is not medical advice.
7. Calls and call recordings
- In-app voice and video calls are provided through Stream. Calls depend on your network and on third-party services, and we do not guarantee that a call will connect, ring, or stay connected. Calls in the app cannot reach emergency services.
- Calls may be recorded according to each person's recording setting. The app tells everyone on the call before recording starts and shows a notice while it runs. You are responsible for using recordings lawfully, including any surveillance-device or recording laws that apply where you and the other person are.
8. Notifications and reminders
Reminders and notifications (including medication, handover and event reminders, and incoming calls) are delivered through Apple, Google and Expo and can be delayed, missed or switched off by your device. Do not rely on the app as your only reminder for anything safety-critical, such as a child's medication.
9. Subscriptions and billing
- New accounts get a 14-day free trial. After it ends, a paid subscription is needed to keep adding to your records. You can still read and export your records without one.
- In the iPhone or Android app, subscriptions are sold and billed by the Apple App Store or Google Play (managed for us by RevenueCat), under their terms. They renew automatically until you cancel in your App Store or Google Play account settings, and refunds are handled by Apple or Google under their policies.
- On the website, subscriptions are billed by card through Stripe. They renew automatically until you cancel from the billing page in the app. Refund requests for web subscriptions are made to us.
- You only need one subscription. If you subscribe through more than one store, cancel the one you don't need; we cannot cancel or refund an Apple or Google purchase for you.
- Prices, trial terms and renewal terms are shown before you buy. We may change prices for future billing periods with notice. Promotional codes are subject to the terms shown when you redeem them and can be withdrawn for future redemptions.
10. Third-party services, information and links
- The app relies on third-party providers (listed in the Privacy Policy) for hosting, email, calls, notifications, payments and AI. We are not responsible for outages or failures of those services, but we choose them carefully and remain responsible for how we use your information.
- Some information in the app comes from public sources, such as school term and holiday dates from education departments and exchange rates from the Reserve Bank of Australia. It is provided for convenience, may be out of date or wrong, and should be checked with the school or official source. Exchange rates are indicative only.
- When we verify a professional (for example a lawyer), we check their details against public registers such as the Australian Business Register or the New Zealand Business Number register. A verified status confirms those details matched; it is not a recommendation of the professional or confirmation of their qualifications.
- The app links to third-party websites (such as law societies and support services). We are not responsible for their content.
11. Disclaimers and liability
The app is provided "as is". To the extent permitted by law, we exclude implied warranties. Nothing in these Terms excludes rights you have under the Australian Consumer Law (or the New Zealand Consumer Guarantees Act 1993) that cannot be excluded. To the extent permitted by law, our liability is limited to resupplying the service or the amount you paid in the previous 12 months.
12. Termination
You may stop using the app at any time. We may suspend or terminate access for breach of these Terms. Retention of records continues as described in the Privacy Policy.
13. Apple App Store and Google Play
If you downloaded the app from the Apple App Store:
- these Terms are between you and CoParent Pty Ltd only, not Apple. Apple is not responsible for the app or its content;
- your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store usage rules;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation for the app;
- Apple is not responsible for any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer-protection or privacy claims. CoParent Pty Ltd, not Apple, is responsible for those claims and for any claim that the app infringes a third party's intellectual property;
- you confirm you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the app from Google Play, Google Play's terms also apply to your download and purchases, and Google is not responsible for the app.
14. Open-source software
The app includes open-source software licensed under its own terms (for example MIT, Apache 2.0, BSD and LGPL licences). Those licences apply to those components, and nothing in these Terms limits your rights under them. A list of components and their licences is available on request.
15. Governing law
These Terms are governed by the laws of [INSERT STATE], Australia.
